About these terms

FrogPilot is free, open-source driver-assistance software for cars, a fork of openpilot for comma devices. It’s a hobby project developed and run by FrogsGoMoo, an individual in the United States. In these terms, “we” and “us” mean FrogsGoMoo, and “you” means anyone who uses the website or the services.

Our privacy policy explains what data the website and the services collect and how it’s used.

You’re always the driver

FrogPilot is driver assistance, not self-driving. It doesn’t make your car drive itself, and it can make mistakes at any time.

• Stay attentive, with your eyes on the road, and be ready to take over at every moment.
• You’re in charge of your car and responsible for how it’s driven, whatever FrogPilot is doing.
• Follow the laws where you drive, and only use FrogPilot where using it is allowed.

Experimental and provided as is

FrogPilot is experimental software. It changes often, development branches change even more often, and any version can behave in ways you don’t expect.

FrogPilot’s code is released under the MIT license, which governs your use of the code, including its own disclaimer of warranties. Nothing in these terms takes away rights the MIT license gives you.

The website and the services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the extent the law allows. That includes any warranty that they’re fit for a particular purpose, accurate, uninterrupted, or free of errors. They’re free, and we can change, limit, pause, or stop any part of them at any time.

Limits of liability

To the extent the law allows, we aren’t liable for any damages arising from your use of FrogPilot, the website, or the services, including damage to vehicles or property, injury, or any indirect, incidental, special, or consequential damages, even if we were told they were possible.

Some places don’t allow these limits, so they apply only as far as your local law permits. Nothing in these terms takes away rights you have as a consumer that can’t be waived.

Fair use of FrogPilot’s services

FrogPilot’s online services are shared by everyone who uses FrogPilot, so please use them only the way the FrogPilot software does. Don’t

• overload, scrape, or attack the services, or try to reach data that isn’t yours,
• send fake devices, data, or requests, or pretend to be another device,
• try to get around rate limits, bans, or other limits, or
• upload anything unlawful, harmful, or that you don’t have the rights to.

To protect the services, we can limit, suspend, or ban a device or network, automatically or by hand, including for abuse, and the services have capacity limits that apply to everyone. If you find a security problem, please report it privately as our security page describes.

What you send us

When you share FrogPilot data or send an issue report, you let us use it as our privacy policy describes. Please don’t include other people’s personal information in issue reports.

Theme submissions

When you submit a theme, you confirm that you made everything in it or have permission to use it, and that sharing it won’t break any law or anyone else’s rights.

You keep ownership of your theme. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, review, and share it, including with FrogPilot users through FrogPilot’s downloads, website, and community channels. We can adjust it so it works in FrogPilot.

We can decline any submission, and remove any theme at any time.

Other services

FrogPilot runs on comma devices and works alongside other services we don’t control. comma’s own services, such as comma connect and comma’s device and upload services, are covered by comma’s terms and privacy policy, not ours. The same goes for other services FrogPilot can use, such as Konik, GitHub, Discord, Mapbox, OpenWeather, and Tailscale, each under its own terms.

Stopping

You can stop using the website and the services at any time, and ask us to delete your data as our privacy policy describes. We can end your access to the services if you break these terms.

Governing law

These terms are governed by the laws of the United States, without regard to conflict of laws rules. If your local consumer law gives you the right to bring a claim where you live, these terms don’t take that away.

Changes to these terms

These terms take effect on [date to be confirmed].

When we change these terms, we’ll update this page and its “Last updated” date. For significant changes, we’ll also post on the FrogPilot blog. If you keep using the website or the services after a change, the new terms apply.
